Car Sold But Not Transferred? Complete 2025 Guide for Vehicle Owners in India

India me vehicle sale ke baad ownership transfer ek legal requirement hai. Lekin aksar hota hai ki seller ne apni gaadi bech di, par buyer ne RC apne naam par transfer nahi ki. Is situation me purane owner ke liye kaafi risk hota hai — challan, accident liability, ya criminal case tak ho sakta hai. Why Ownership Transfer is Critical

Ownership transfer ka matlab hai ki RTO ke record me gaadi ka legal malik badal jana. Jab tak RC me naam change nahi hota, purane owner ko gaadi ka legal owner maana jata hai. Iska matlab:

  • Agar accident hota hai to FIR aapke naam par ho sakti hai

Relevant Law in India

Motor Vehicles Act, 1988 ke Section 50 ke hisaab se vehicle ownership transfer ke liye buyer ko 14 din (same RTO jurisdiction me) aur 45 din (different RTO jurisdiction me) ka time diya gaya hai. Seller ko bhi 14 din ke andar RTO me intimation dena mandatory hai. Agar aisa nahi hota to dono parties penal action ka samna kar sakte hain.

Steps to Follow If Buyer Has Not Transferred the Car

1. Proof of Sale Collect and Keep Safe

Sabse pehle, sale ka proof rakho. Isme Delivery Note, Payment Receipt, aur Form 29 & 30 ke signed copies shamil honi chahiye. Agar yeh documents nahi banaye the, turant buyer se sign karao ya apne RTO se guidance lo.

2. RTO Me Ownership Transfer Intimation

Apne RTO me ek written application submit karein jisme likha ho ki aapne gaadi bech di hai. Iske saath buyer ka naam, address, Aadhaar copy, aur sale ki date attach karein. Application ke saath Delivery Note ka copy bhi lagayein. Isse RTO ke record me officially note ho jayega ki gaadi aapke paas nahi hai.

3. Buyer Ko Legal Notice Bhejein

Registered Post (with acknowledgement) ke through buyer ko ek formal legal notice bhejein jisme clearly likha ho ki wo 7 din ke andar RC transfer kare. Agar wo ignore karta hai to yeh proof aapke paas future legal proceedings me kaam aayega.

Kindly initiate the transfer within 7 days from the receipt of this letter, failing which I will proceed with legal action and inform the RTO and Police authorities.

4. Insurance Company Ko Inform Karein

Insurance provider ko writing me inform karein ki aapne gaadi bech di hai. Policy cancel karke apna No Claim Bonus (NCB) protect karein. Is step ka proof rakho, taaki koi bhi future claim aapke against na ho.

5. Police Complaint (If Necessary)

Agar buyer cooperate nahi karta, to apne local police station me ek written complaint jama karein. Complaint me vehicle details, sale date, aur buyer ki details likhkar ek copy apne paas rakhein. Police se acknowledgment slip lena mat bhooliye.
