What Happens If You Don't Transfer Ownership After NOC Is Issued? – 2025 RTO Guide

Many vehicle owners believe that once a NOC (No Objection Certificate) is issued, their responsibility ends. However, this is not true. If ownership is not transferred after NOC issuance, you may face legal and financial troubles. In this post, we answer the most common questions on this issue.

Q1. Is it necessary to transfer ownership after obtaining NOC?

Yes, absolutely. Once the NOC is issued from the original RTO, the next step is to register the vehicle in the new RTO’s jurisdiction. Without this, the vehicle remains registered under the old owner, and legally, they remain responsible for the vehicle.

Q2. What if I don't complete the transfer after receiving NOC?

If you do not complete the transfer process, several complications can arise:

  • Legal Liability: You may still be held liable for any accidents, crimes, or violations involving the vehicle.
  • Pending Challans: Any future traffic fines will be issued in your name.
  • Insurance Claims: Insurance companies may reject claims if ownership isn’t updated.

Q3. Does the NOC have an expiry date?

Yes. Typically, a NOC is valid for 6 months from the date of issuance. If the transfer is not completed within this period, the NOC may become invalid, and you might need to apply for a new one or get the old one cancelled.

Q4. Can the NOC be cancelled?

Yes, if the transfer is not going to take place, you can visit the original RTO and request cancellation of the NOC. You will need to submit a written application and provide the original NOC copy.

Q5. What happens if the vehicle is moved to a different state without transfer?

Using a vehicle in another state without transferring ownership after NOC can lead to penalties or even vehicle seizure. According to RTO rules, any vehicle operating in a new jurisdiction must be re-registered with the local RTO.

Q6. Will the original owner receive notices even after selling the vehicle?

Yes. Until the RC is officially updated with the new owner's name, all legal notices, challans, and liabilities remain with the person whose name is on the registration certificate – i.e., the original owner.

Q7. How can I check if the ownership transfer is complete?

You can verify the ownership status by visiting Parivahan.gov.in and checking the RC status using the vehicle registration number.

Q8. What documents are required to transfer ownership after NOC?

Commonly required documents include:

  • Original RC
  • NOC issued by the original RTO
  • Form 29 and Form 30
  • Copy of valid insurance
  • PUC Certificate
  • ID proof and address proof of the buyer
  • Passport-size photos

Q9. What should I do if the NOC has expired?

You have two options:

  1. Apply for a fresh NOC by submitting a new request at the original RTO.
  2. Request for cancellation of the old NOC and continue using the vehicle in the original RTO’s jurisdiction.

Q10. Can I sell my vehicle after getting NOC but before transferring?

No. Technically, the vehicle should first be transferred and registered in the new RTO. Selling a vehicle without a valid RC in the buyer’s name can lead to future disputes and legal issues.
